This Privacy Policy explains how KAP Holdings LLC d/b/a Poppy & Pine ("Poppy & Pine," "we," "us," or "our") collects, uses, discloses, and protects information associated with our text messaging program. It applies to SMS and MMS communications sent to or received from our business number.

We may collect your mobile phone number, name, message content, message timestamps, delivery and response information, consent and opt-out records, and information related to your reservation, waitlist request, order, catering inquiry, loyalty account, customer service request, or other interaction with Poppy & Pine.

We may also receive limited technical information from our communications providers, such as carrier information, delivery status, and device or network data used to route or troubleshoot messages.

We may use SMS-related information to respond to your requests; manage reservations, waitlists, orders, catering inquiries, loyalty or rewards communications, and customer service; send transactional or operational updates; send promotional messages only when the appropriate consent has been obtained; maintain consent and opt-out records; prevent fraud, abuse, or security incidents; improve our services; and comply with legal or regulatory obligations.

We may share information with service providers that help us operate our communications systems, including our business communications and messaging providers, hosting providers, customer-management platforms, and vendors that assist with message delivery, consent management, security, analytics, or legal compliance. These providers may use the information only to perform services for us or as required by law.

We may also disclose information if required by law, legal process, or a valid governmental request; to protect the rights, safety, or property of Poppy & Pine, our customers, or others; or in connection with a merger, financing, sale, or transfer of all or part of our business, subject to applicable law.

We do not sell or rent mobile phone numbers or SMS-related personal information.

No mobile information will be shared with third parties or affiliates for their own marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with third parties, except with service providers that are necessary to operate our text messaging program or as required by law.

We retain SMS-related information for as long as reasonably necessary to provide services, maintain business and consent records, resolve disputes, enforce agreements, and satisfy legal, accounting, or compliance requirements. Retention periods may vary depending on the type of information and the reason it was collected.

We use reasonable administrative, technical, and physical safeguards designed to protect information. However, ordinary SMS and MMS communications are not encrypted end-to-end, and no method of transmission or storage is completely secure. Do not send passwords, full payment-card numbers, Social Security numbers, medical information, or other highly sensitive information by text.

You may opt out of text messages at any time by replying STOP. You may request help by replying HELP. You may also contact us to ask questions about your information or to request correction or deletion where required by applicable law. We may need to retain certain records for legal, compliance, fraud-prevention, or transaction-related purposes.

Our text messaging program is not directed to children under 13, and we do not knowingly collect personal information from children under 13 through the program. If you believe a child has provided information to us, please contact us.

We may update this Privacy Policy from time to time. Changes will be posted on this page with a revised effective date.
