SMS Terms of Service

These SMS Terms of Service ("SMS Terms") govern text messages sent by or on behalf of KAP Holdings LLC d/b/a Poppy & Pine ("Poppy & Pine," "we," "us," or "our"). Our text messaging program may be used for customer-initiated conversations, reservation and waitlist communications, order or catering updates, customer service, event information, loyalty or rewards communications, and promotional messages when you have separately agreed to receive them.

You may consent to receive text messages by texting our business number, requesting that we contact you by text, or providing your mobile number through a form or other process that clearly asks for permission to send text messages.

Providing a phone number for a reservation, order, waitlist, or other transaction does not by itself authorize recurring promotional text messages unless you separately provide the required consent. Consent to receive promotional text messages is not a condition of purchasing goods or services.

Message frequency varies based on your interactions with us. Transactional and conversational messages are sent as needed. If you separately subscribe to promotional messages, you may receive up to 4 promotional messages per month, although frequency may vary during special events or seasonal campaigns.

Message and data rates may apply. Your mobile carrier may charge you for sending or receiving text messages according to your wireless plan. Poppy & Pine is not responsible for carrier charges.

You may opt out at any time by replying STOP to any message from us. You may also use other commonly recognized opt-out words, including CANCEL, END, QUIT, or UNSUBSCRIBE. After you opt out, you may receive one final confirmation message. You will not receive additional promotional messages unless you opt in again.

An opt-out from promotional messages does not prevent us from responding to a new text that you initiate or from sending non-promotional messages that are necessary to complete a transaction you requested, where permitted by law.

Text messaging may not be available on all devices or through all mobile carriers. Wireless carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier and network provider and is not guaranteed.

You represent that you are the authorized user of the mobile number you provide. If you change or deactivate your number, you agree to notify us or opt out before the number is reassigned. You agree not to use our text messaging service for unlawful, abusive, fraudulent, or harassing purposes.

Our collection and use of information in connection with the text messaging program is described in our Privacy Policy. The Privacy Policy is incorporated into these SMS Terms by reference.

We may update these SMS Terms from time to time. Changes will be posted on this page with a revised effective date. Your continued participation in the text messaging program after an update becomes effective constitutes acceptance of the revised SMS Terms, to the extent permitted by law.

We may suspend or terminate the text messaging program, or your participation in it, at any time. Termination does not limit any rights or obligations that arose before termination.

These SMS Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles, except where federal law applies.
